Terms and Conditions

General Conditions

Pilot Area 2 Boundary:
Bounded by Woodgrove Crescent on the north, Lansdowne Street West on the south, Brealey Drive on the west, and Kawartha Heights Boulvard on the east.

Parking Permits are only valid for parking on the street for which they are issued.

Permit Types and Fees

Visitor Permit: Valid for 24-hours: $20.00
Day Permit: Valid for 24-hours: $20.00
Two-Day Permit: Valid for 48-hours: $35.00 
Week Permit: Valid for 7-days: $120.00
One Month Permit: Valid for 1-month: $150.00 
Six Month Permit: Valid for 6-months: $200.00
Annual Permit: Valid for 12-months: $250.00

Annual Permit Limits per municipal address:

Maximum of 3 long-term permits at any one time. 

Maximum of 10 free 24-hour permits, which may include a visitor permit.

Definitions

Annual Permit Limits – means the maximum number of long-term permits that may be held by a resident at a legal address within Residential On-Street Parking Permit Pilot Area 2.

Applicant – means the registered owner of the Motor Vehicle for which the Parking Permit has been issued.

Application – means the application containing the information required by the City.

City – means, as the context requires, an Officer or the Corporation of the City of Peterborough
Eligible Motor Vehicle – means a motor vehicle, with or without an attached trailer, that meets all of the following criteria:

1. Dimension Requirements for a Registered Vehicle

  • The combined length of the vehicle and any attached trailer does not exceed 20 metres.
  • The combined width of the vehicle and trailer does not exceed 2.6 metres.

2. Vehicle Type

The following vehicles qualify, with or without trailers, provided they meet dimension limits and use restrictions:

  • Passenger cars, SUVs, and minivans
  • Light duty and medium duty pickup trucks
  • Any of the above which are towing recreational trailers, utility trailers, or equipment trailers

4. Exclusions

The following are not eligible:

  • Vehicle–trailer combinations that exceed the dimension requirements, or that fail to meet any other restrictions
  • Heavy commercial vehicles such as: Transport trucks / tractor trailers; Cube vans, straight trucks, or large freight carriers; Construction or industrial vehicles towing oversized loads
  • Any combination requiring special permits for oversize or overweight operation
  • Vehicles and/or trailers connected to services (sewer, water or electricity)
  • Trailers not connected to a motor vehicle

Highway – includes a common and public Highway, street, avenue, or parkway, any part of which is used or intended for use by the general public for the passage of vehicles.

Long-term Permit – means a permit issued with a specified duration of 1 month, 6 months, or 12 months.  

Motor Vehicle – means a motor vehicle as defined in Highway Traffic Act 

Officer – means: 

  1. The Supervisor of Parking;
  2. Each person from time to time appointed as a municipal law enforcement officer to enforce a City by-law;
  3. Each assistant to the Fire Marshal employed by the City; and
  4. A police officer employed by Peterborough Police Service or the Ontario Provincial Police. 

Parking Permit – means a non-transferrable electronic parking permit issued to a person for a Registered Vehicle.

Permit Holder – means a person who resides at a property within, or is a visitor to a property located within, the Residential On-Street Parking Permit Pilot Area 1 (Downtown).

Registered Vehicle – means the Motor Vehicle which is the subject of the Parking Permit.

Pilot Area Zone – means the streets or sections of streets that are located within the boundaries in the General Terms and Conditions.

Supervisor of Parking – means the person authorized to give effect to the provisions of By-law number 09-136 the Parking By-law.

The Applicant and Permit Holder accepts the following terms as a condition of the City’s issuance of a Parking Permit:

  1. The Registered Vehicle is parking on a Highway at the Applicant’s sole risk.
  2. The Corporation of the City of Peterborough accepts no liability for any form of loss or damage, whether to the Registered Vehicle, its contents, to the Owner, or to any person, howsoever such loss or damaged is caused.
  3. The Permit Holder gives their irrevocable representation that they have read and understood the City’s Parking By-law and will abide by the prohibitions contained therein. Specifically, the Permit Holder has read and understood Section 4.0 General Parking and Stopping Prohibitions – Other Regulations. Not withstanding the foregoing, the Parking Permit only exempts the Owner from Section 4.35 and 4.36 of Parking Bylaw 09-136. 

    “4.35 General Time Limit: No person shall park a Vehicle on a Highway for a period longer than 3-hours, unless an Official Sign is displayed which indicates otherwise. 

    “4.36 Seasonal Offence: Notwithstanding Article 4.35, no person shall Park a Vehicle on any Highway between the hours of 2:00 a.m. and 6:00 a.m., during the time period from December 1st of any year to April 1st of the following year.” 

    Under Section 14.7 of By-law 09-136, a Registered Vehicle with a Parking Permit shall be forthwith relocated, at the owner’s expense, to facilitate snow removal, maintenance operations, or when instructed to do so by the City. 

    All contraventions of the City’s Parking By-law will be enforced under the City’s AMP System By-law 20-73 and under By-law 20-075.

  4. All vehicles parked pursuant to a City permit or in a City facility, must be operable and have a valid motor vehicle licence plate attached. Vehicles which do not comply with the foregoing requirements may be removed at the owner’s expense.
  5. The City may give notice to the Applicant in any of the ways described in Section 15 of By-law 20-073. It is the Applicant’s responsibility to forthwith forward any notice given by the City to the Permit Holder.

The Following Applies to all Parking Permits

  1. The Permit Holder agrees that the Parking Permit allows them to park their Registered Vehicle on the specified Highway within Pilot Area 2 and only for the duration of the Parking Permit.
  2. The application for a Parking Permit shall include Applicant’s and the Permit Holder’s information being:(1) the name, address and current email address for each Motor Vehicle owner and (2) the Registered Vehicle’s license plate number, make, model, color and year of make (3) and licence plate number for any trailer.
  3. Only the Registered Vehicle identified in the Parking Permit is permitted to use the Parking Permit on a Highway within the assigned zone. Parking Permits may be transferred between vehicles owned by the applicant, subject to approval by Supervisor of Parking or designated individual.
  4. Parking Permits are offered on a first-come, first-served basis, and are subject to the availability of on-street parking as determined by the Supervisor of Parking. The City makes no commitment to renewing a Parking Permit. The City does not guarantee availability of parking spaces on a Highway within the Pilot Area. The Permit Holder acknowledges that parking spaces are available on a first-come, first-served basis.
  5. At any time and for any reason, the City may amend the Parking Permit to require the use of a different Highway.
  6. Permit Holders may only park on specific Highways within the specified Pilot Area.
  7. Individual parking spaces cannot be reserved.
  8. Permit Holder agrees to relocate a Registered Vehicle at least once every 72 hours. Failure to do may result in the cancellation of the Parking Permit.
  9. Parking Permits are valid for the duration specified for the applicable permit type and commence on the date of purchase. Renewal is subject to the approval of the Supervisor of Parking. Renewal of a Parking Permit, if permitted, must be done on or before the expiration date.
  10. No credit or refunds will be issued for periods of non-use of a Parking Permit, or if a Permit Holder cannot find a parking space on the designated Highway on a particular day.
  11. If a Permit Holder wishes to cancel a Parking Permit, the Permit Holder must provide the City's Supervisor of Parking a minimum of 10 calendar days written notice prior to expiration date. There will be no refunds for part months. Refunds will be pro-rated for any remaining full months of the permit.
  12. The Supervisor of Parking may revoke a Parking Permit for any reason. If a Parking Permit is revoked, written notice will be provided with a minimum of 10 calendar days’ notice. A refund will be pro-rated and issued for any remaining full months. There will be no refunds for part months.
  13. Fraudulent or improper use of a Parking Permit will result in the immediate cancellation of the Parking Permit. There will be no refund.
  14. The fee for a Parking Permit is subject to change by the City.
  15. Permits are valid for 24 hours each day, 7 days a week, subject to such exceptions as may be enacted by the City. Notwithstanding the foregoing, the Owner is responsible for ensuring that their Motor Vehicle is removed from the Highway when directed to do so by an Officer or by the Supervisor of Parking.
  16. Any decision made by the City's Supervisor of Parking concerning whether or not to (a) issue a Permit (b) issue a refund (c) revoke or cancel a Parking Permit is final and not subject to review.
