What is an Alternative Solution?

An alternative solution is a different way to meet the Ontario Building Code (OBC) requirements instead of following the standard methods listed in the Code. The alternative must meet or exceed the performance and safety standards set by the OBC.

How to Apply for an Alternative Solution

Step 1: Notify the Building Services Division

  • Inform the Building Services staff about your proposal for an Alternative Solution as part of your permit application. It is best to pre-consult with review staff before submitting your full building permit application. Give yourself ample time ahead of the project to ensure all information is submitted and staff has time to review.
  • A separate Alternative Solution Permit (ASP) folder will be created in the permit system for your submission.
  • You can upload required documents through the Online Application Portal after the folder has been created.
  • Each alternative solution requires a separate application. 

Step 2: Submit Required Documents

You need to submit the following forms and reports:

  • Alternative Solution Application Form – This form will be automatically created in the portal.
  • Owner’s Authorization Form – Required if you are not the property owner.
  • Consultant’s General Review & Commitment Form – Confirms the involvement of engineers, architects, or other consultants.
  • Alternative Solution Report – Prepared by a licensed engineer, architect, or qualified designer (see below).
  • Other Supporting Documentation – This may include test results, engineering studies, or modeling data that demonstrate compliance with the OBC.

Alternative Solution Report Requirements

Your report must include:

  1. Proposal Summary – Describe how the alternative solution differs from standard OBC methods.
  2. Compliance Baseline – Specify the code-compliant method as a backup if your proposal is not approved.
  3. Building Code Analysis – Explain how your solution meets OBC requirements.
  4. Performance Justification – Provide evidence (test results, engineering studies, modeling, etc.) proving compliance.
  5. Assumptions & Factors – List any assumptions, testing methods, or limitations.
  6. Maintenance & Operational Requirements – Outline any ongoing upkeep needed for compliance.
  7. Supporting Drawings & Materials – Include relevant plans and sections showing how the solution will be applied.

Step 3: Staff Review and Decision

  • Once submitted, the Chief Building Official or a designated reviewer will assess your application.
  • You will receive a response indicating whether your solution is accepted, rejected, or requires changes on the portal.

Important Notes

  • Each alternative solution is reviewed on a case-by-case basis and applies only to the specific project and site.
  • If you want to use the same alternative solution for another project, you must submit a new application for approval.
  • Fees for this process are under review.
