1. Purpose

This Privacy Guideline describes how we collect, use and disclose your information and how this information can be accessed and deleted when necessary.

2. Consent

By using PTBOnDemand, you accept the terms and conditions described in this Privacy Guideline.

3. Scope

PTBOnDemand may contain links to websites, apps, products or services that are operated by third parties. This Privacy Guideline does not extend to these third parties over which we have no control and for which we cannot be held liable. We encourage you to read about the privacy policies, procedures and practices of those third parties. 

4. Collection

The City of Peterborough, through Peterborough Transit, gathers various information about users of the PTBOnDemand program (“PTBOnDemand”), including but not limited to through the mobile and online trip scheduling applications (the “Applications”). This information includes:

  • Personal information about you, provided through voluntary registration;
  • Personal information regarding your use of PTBOnDemand, including but not limited to times and locations of trips booked, taken, or cancelled, and saved locations;
  • Personal information, provided to us by you through any other method (including without limitation correspondence and discussions); and
  • Eligibility information for specialized transit services.

The personal information collected will be held by us or on our behalf or by such other agent as we may appoint from time to time. Via Transportation Inc., the City’s third-party contractor, will have access to all personal information collected by PTBOnDemand for purposes related to management and administration of PTBOnDemand. Information may be stored on servers located in Canada or the United States. 

5. Authority to Collect Personal Information

Personal information is being collected for the purposes set out in section 4 above. This information is collected under the legal authority of Section 10(1) of the Municipal Act, 2001 for the purpose of administering the PTBOnDemand program in the City of Peterborough. 6. Location Information

PTBOnDemand will collect geo-location information, including your trips origin and destination, and will access and use the precise geo-location of your devices running the Applications. This location information is used to facilitate trip planning and trip updates. The Applications will only access and use your device’s location information if you give the Application permission through your device settings or the Application itself.

7. Purposes

The personal information you provide will be used for the following purposes:

  • To allow you to use PTBOnDemand;
  • To provide you with further information about PTBOnDemand or other services, rewards, and/or promotions offered by us or which we consider may be of interest to you;
  • To verify your identity and assist in technical, administrative and/or service inquiries (e.g. password reset, pre-paid payments);
  • To investigate any complaints relating to misuse of PTBOnDemand or misconduct in relation to PTBOnDemand and to take any action deemed necessary to protect your safety and the safety of others in relation to those complaints;
  • To assist in making accommodations for specialized transit services;
  • To analyze in aggregate form (identifiable characteristics removed so that you will remain anonymous) for the purposes of continuous service improvement; and
  • To disclose as may be required under applicable law, including but not limited to the Municipal Freedom of Information and Protection of Privacy Act (MFIPPA) (Ontario), as amended or replaced from time to time.

8. Disclosure to Third-Parties

The City does not disclose your information to third parties without your explicit consent except in the following circumstances:

  • To comply with a legal obligation;
  • To protect against legal liability;
  • To protect and defend the rights or property of the City;
  • To prevent or investigate possible wrongdoing in connection with the Services; or
  • To protect the personal safety of users of the Service or the public.

In the above circumstances, the City may disclose your information without your consent if it, in good faith thinks, that such action is necessary. The City may also disclose anonymous and aggregate information to certain third parties for research, product development or other business purposes.

9. Protection of Privacy Statement

With the exception of disclosures listed in section 8 above, we will not sell, lease, share or disclose personal information to private business, organizations or individuals unless required or permitted to do so by applicable law.

10. Security

We are committed to securing your information and we take reasonable physical, organizational and technical measures to protect your information against unauthorized access, use, disclosure, modification or destruction.

These safeguards include, but are not limited to:

  • Storage on secure servers;
  • Encryption of the communication channels; and
  • Limited access to employees and contractors on a “need-to-know” basis.

Although we take great efforts to protect your information, no security system can prevent all potential security breaches nor be immune from any wrongdoings or malfunctions. It is your responsibility to ensure you safeguard your devices appropriately and do not share your login or password.

11. Right to Access Your Information

The City’s Freedom of Information and Privacy Coordinator responds to requests regarding accessing your personal information under MFIPPA. To learn more about this process, contact the Freedom of Information and Privacy Coordinator by calling (705) 742-7777 Ext: 1797.

You are responsible for changing, keeping up-to-date, and maintaining the accuracy and completeness of your own information within the PTBOnDemand Application.

12. Removal of Your Information

To permanently delete your personal information from our servers, you must deactivate your account. We will retain any and all personal information that we are required to retain under any applicable laws for the full duration of time required under those laws. We may also retain any anonymized and de-identified information and continue to use this information in accordance with this Privacy Guideline.

If you would like to remove or access any information that we have collected through PTBOnDemand that is stored on our servers, please contact Via Transportation Inc. at support@ridewithvia.com.

On receiving such a request, Via Transportation Inc. will use reasonable efforts to delete such information. PTBOnDemand is not responsible for any information backed-up or stored on your devices following the de-activation of your account.

13. Changes to this Guideline

The City reserves the right to amend this Privacy Guideline at any time without notice. By using the PTBOnDemand Application, you agree to be bound by the version of the Privacy Guideline displayed on the date upon which you use the Application. If you do not accept the amended Privacy Guideline, you may not access, use or continue to use the PTBOnDemand Application. By continuing to use and access the PTBOnDemand Application, you are acknowledging your acceptance of the amendments.

In any case, the City recommends that you consult this page regularly in order to be informed of any changes in this Privacy Guideline. When the City posts changes to this Privacy Guideline, we will revise the “last updated” date at the end of this Privacy Guideline.
