Report CSACH08-005

Designation of Little Lake Cemetery

Moved by Councillor Farquharson, seconded by Councillor Pappas

a) That the recommendation from the Municipal Heritage Committee (PACAC) not to designate the property known as Little Lake Cemetery at this time as a heritage property under Part IV, Section 29 of the Ontario Heritage Act (R.S.O. 1990 c.O.18) be received; and,

b) That staff be directed to enter into discussions with the Little Lake Cemetery Company to finalize a mutually acceptable conservation plan for the preservation and conservation of the heritage attributes of the cemetery based on acceptable, recognized heritage standards to be finalized on or before February 1, 2009; and,

c) That staff be directed to proceed to register a Heritage Conservation Easement on title with the associated conservation plan; and

d) That the Municipal Heritage Committee (PACAC) and Council will review the issue of heritage designation of Little Lake Cemetery upon completion of the above, or if (b) is unsuccessful by the date set out, to proceed with designation immediately.

Councillor Farquharson requested this item be separated and a recorded vote taken.

Other Business

Councillor Peacock requested an update on the road closure at Erskine Avenue impacting Borden Avenue and High Street. Wayne Jackson, Director of Utility Services, provided information to Council regarding the construction schedule for Erskine Avenue, Borden Avenue and High Street, including traffic flow management. Mr. Jackson advised that the City is awaiting the completion of utility work in the area. A late October or early November completion date is anticipated. Councillor Peacock requested an update on the maintenance of Erskine Avenue, due to recent rain. Mr. Jackson advised that staff are regularly checking and reporting back on the conditions of the catch basins.

THE PLANNING COMMITTEE, AS A RESULT OF ITS MEETING HELD ON SEPTEMBER 22, 2008, RECOMMENDS AS FOLLOWS:

1. Director of Planning and Development

Report PLPD08-059

Application for Condominium Approval

75 Units at 869 Clonsilla Avenue

That Council approve the recommendations outlined in report PLPD08-059 dated September 22, 2008 of the Director of Planning and Development Services as follows:

a) That the application for condominium approval submitted by Kawartha Glen Inc. to exempt 75 units from the Section 50 requirements of the Planning Act (as amended) in accordance with Subsection 50(3) of the Condominium Act (as amended) at 869 Clonsilla Avenue be approved.

b) That the condominium plans be submitted to the satisfaction of the Director of Planning and Development Services Department.

c) That the Director of Planning and Development Services be given authorization to stamp, date, and sign the condominium plans indicating approval, by the Council of the Corporation of the City of Peterborough, under Section 50 of the Condominium Act, (as amended).

d) That the registration of the condominium plans be withheld until such time as the majority of site work is complete, and the Building Division indicates that all the units are ready for occupancy.

Coldsprings Transportation Study Public Information Centre

That Council approve the recommendations outlined in Report PLPD08-035A dated September 22, 2008 of the Director of Planning and Development Services, as follows:

a) That the results of the Coldsprings Transportation Study Public Information Centre held on June 4, 2008 be received;

b) That the Coldsprings Transportation Study completed by Earth Tech Canada Inc. serve as the basis for the completion of the Coldsprings Functional Planning Study; and,

c) That the correspondence from the Township of Otonabee-South Monaghan dated September 15, 2008 be received and that the issues of concern raised by the Township be addressed during the preparation of the Coldsprings Secondary Plan.

That Council approve the recommendations outlined in Report PLPD08-071 dated September 22, 2008, of the Director of Planning and Development Services, as follows:

a) That the zoning of the subject property be amended from the SP. 323 – ‘H’ – Residential District to a modified SP.323 F – ‘H’ – Residential District in accordance with the draft amendment attached as Exhibit ‘C’ to Report PLPD08-071.

b) That the ‘H’ Holding Symbol be removed upon Site Plan Approval being granted for the subject property, including an acknowledgement of the existing private service connections to the westerly building, over the adjacent lands known as 174 Clifton Avenue.

That Council approve the recommendations outlined in Report PLPD08-056A dated September 22, 2008, of the Director of Planning and Development Services, as follows:

a) That the zoning of the subject property, be amended from the R.1, R.2 - Residential District to the SP.241-241‘H’ – Special District Commercial in accordance with the draft amendment attached as Exhibit ‘D’ to Report PLPD08-056A.

b) That the ‘H’ Holding Symbol be removed once Site Plan Approval is granted for the subject property, including an encroachment agreement with the City of Peterborough to recognize the existing encroachment of the driveway onto the adjacent City property to the south.

Application for Site Plan Approval for 161, One Storey, Row House type dwelling units; and By-Law to Remove an “H” – Holding symbol from the Zoning of the Property at 301 Carnegie Avenue

That Council approve the recommendations outlined in report PLPD08-073, dated September 22, 2008, of the Director of Planning Development Services, as follows:

a) That the site plan application submitted by Triple T Holdings Limited, for the construction of 161 row type single storey condominium units at 301 Carnegie Avenue be approved, subject to the following conditions:

i) The submission of all requested revision work and technical information to the satisfaction of the Site Plan Committee,

ii) The issuance of a permit by the Otonabee Region Conservation Authority,


iii) The deposit of a parks levy in accordance with The Planning Act, as amended,

iv) The deposit of site work performance security in the amount of $2,000.00 per unit,

v) The establishment of a 6.0 metre wide easement through the property for a water main to the satisfaction of Peterborough Utility Services Inc.,

vi) The conveyance of all lands zoned OS.1 to the City, at no cost and free of encumbrances.

vii) The implementation of an environmental monitoring program as outlined in the “Brown Property Draft Plan of Subdivision Part Lot 19, Concession 3 Environmental Study” authored by Niblett Environmental Associates Inc., dated January, 2007.

viii) A cash deposit in the amount of $30,000.00, for the construction of an asphalt sidewalk linking the proposed driveway entrance to the driveway entrance at 227 Carnegie Avenue.

ix) The conveyance of land for future road widening purposes, along the property’s frontage on Carnegie Avenue, to achieve a 15.24 wide road allowance width measured from the centre line of the right of way.

b) That the property at 301 Carnegie Avenue be rezoned from SP. 312-“H” – Special District Residential, to SP. 312 – Special District Residential, in accordance with Exhibit G attached to Report PLPD08-073.

That Request for Proposals Document P-39-08 for the Loading, Transportation and Recycling/Disposal for Municipal Hazardous or Special Wastes be awarded to Clean Harbors Canada Inc., 1831 Allanport Road, Thorold, Ontario L2V 3Y9 per the unit costs as shown in Appendix 1, for the contract period of November 1, 2008 to October 31, 2009, with the option to extend for two additional one-year periods, at the City’s discretion.

That Tender Document T-38-08, for the Replacement of Existing High Efficiency Gas Vent Piping at Various Social Housing Locations be awarded to Limcan Walker Lakeshore Heating and Air Conditioning, a Division of Lennox Canada Inc. at a total cost of $204,975.00 plus $10,248.75 GST, PST not applicable, for a total of $215,223.75 including all taxes.

Heritage Property Tax Relief Program Exception

That Council approve the recommendation outlined in Report CSACH08-011, dated September 29th, 2008, of the Director of Community Services as follows:

That Council pass a by-law to provide an exception to Section 7 of by-law 03-208 allowing the Property at 269 Edinburgh Street, known historically as Smith Town Hill House, to be included in the HPTRP.

Recommendation To Designate Heritage Properties

That Council approve the recommendations outlined in Report CSACH08-012 dated September 29, 2008, of the Director of Community Services, as follows:

a) That the recommendation of the Peterborough Architectural Conservation Advisory Committee (PACAC) to designate the properties at 361-365 George Street North, 478 Murray Street, and 1545 Monaghan Road as heritage properties under Part IV, section 29 of the Ontario Heritage Act (R.S.O. 1990, c.0.18) being of “cultural heritage value or interest”, be approved; and,

b)That Council’s intention to designate be advertised in a newspaper having general circulation in the municipality as per the Ontario Heritage Act R.S.O. 1990, c. O.18, s. 31 (3); and,

c) That the owners of the properties to be designated, and the Ontario Heritage Trust, be served with a notice of intention to designate as per the Ontario Heritage Act R.S.O. 1990, c. O.18, s. 29 (3)

Award Of RFP P-26-08 Delivery Of Homemaker Services

That Council approve the recommendation outlined in Report CSSS08-015 dated September 29, 2008, of the Director of Community Services, as follows:

That the RFP (P-26-08), for the delivery of homemaker services be awarded to Nightingale Nursing Registry Ltd., 2948 Lakefield Road, Peterborough, ON K9J 6X5, for the period January 1, 2009 to December 31, 2011 with the option of two additional one year renewals to a maximum hourly rate of $22.59 per hour, (PST/GST not applicable).

City of Orillia

Coal Generation in Ontario

That correspondence CORRESP08-053 from the City of Orillia requesting Council’s support, that the Ontario government not close the four coal generation plants and that they limit the natural gas generation in our electrical fuel mix and further that this resolution be forwarded to the Premier of Ontario, the Minister of Energy and Infrastructure, the Association of Municipalities of Ontario, the Federation of Canadian Municipalities, all members of Provincial Parliament and all Ontario Municipalities, be received for information.

Egg Laying Hens Confined in Battery Cages

That correspondence CORRESP08-054 from the Humane Society International regarding egg laying hens confined in battery cages and a request that the City of Peterborough make more humane choices and ethical purchasing decisions, such as certified organic eggs and consider adopting a draft resolution regarding this matter as presented by Human Society International (Canada), be received for information.

a) That the Strategic Plan Presentation be received for information; and

b) That the Strategic Plan be used, subject to budget guidelines/ mandate, as a planning guide for the future development of the Peterborough Public Library’s annual budget and work plan submissions for the period of 2008 - 2013.

RFP P-28-08 - Recycling Collection Services

That Council approve the recommendation outlined in Report USWM08-015 dated September 29, 2008 of the Director of Utility Services, as follows:

That Request for Proposals Document P-28-08, for the collection of recyclable materials be awarded to Waste Services (CA) Inc., 688 Harper Road, Peterborough, Ontario K9J 6Y8 at a unit cost of $143.50 per tonne (PST not applicable), and GST of $7.18, for a total unit cost of $150.68 per tonne, subject to cost of living and fuel charge adjustments, for the contract period of January 1, 2009 to December 31, 2016 with the option to extend, at the City’s discretion, for two additional twelve month periods.

Report USTR08-022

Public Meeting Regarding the Proposed Sidewalk on Middlefield Road

That Council approve the recommendations outlined in Report USTR08-022 dated September 29, 2008, of the Director of Utility Services, as follows:

a) That the results of the Middlefield Road Sidewalk Public Meeting held on September 9, 2008 be received; and

b) That Council approve construction of a sidewalk on the south side of Middlefield Road (in the standard location unless where it is possible to modify the location to accommodate more off-street parking), from Otonabee Drive to connect to the existing sidewalk immediately west of Trailview Drive.

That item b) be struck and replaced with:

Option 3 - Sidewalk on North Side of Middlefield Road (closer to or at curb)

The option to build the sidewalk closer to the road or at the curb-face on the north side of the road appears to be viable. The same standard underground utility locations may influence the sidewalk placement but there are few above ground utility facilities on the north side of the road to deal with. Confirmation of this information with the utility companies would be required.

That an item c) be added as follows:

That this report and meeting minutes from the September 9, 2008 Community Information Meeting be forwarded to STSCO and the School Boards and that STSCO be requested to respond to the safety issues in writing within ten working days.

Council at its meeting of October 6, 2008, made the following recommendation:

d) That STSCO provide confirmation that transportation will be provided until a sidewalk is installed and that use and maintenance issues regarding the path between Otonabee Drive and Otonabee Valley School be clarified.

That Council approve the recommendation outlined in Report CPFPRS08-016 dated September 29, 2008, of the Senior Director of Corporate Services, as follows:

That Request for Proposals P-05-08, for the Collection Services of Outstanding Accounts for the City of Peterborough for the period of November 1, 2008 to December 31, 2011 be awarded to NCO Financial Services Inc., 6700 Century Avenue, Suite 210, Mississauga, Ontario, L5N 6A4.

Enhanced Budget for MorrowPark Master Plan

That Council approve the recommendation outlined in Report CSAD08-008 dated September 29, 2008, of the Director of Community Services, as follows:

That $20,000 from the Arena Division Capital Budget for Morrow Park Grandstand, originally allocated to the Grandstand repairs and Temporary Grandstand rentals, be transferred to the Morrow Park Master Plan project to increase the budget to $60,000.

Report CSACH08-005

Designation of Little LakeCemetery

That Council approve the recommendations outlined in Report CSACH08-005 dated September 29, 2008 of the Director of Community Services, as follows:

a) That the recommendation from the Municipal Heritage Committee (PACAC) not to designate the property known as Little Lake Cemetery at this time as a heritage property under Part IV, section 29 of the Ontario Heritage Act (R.S.O. 1990, c.O.18) be received; and,

b) That staff be directed to enter into discussions with the Little Lake Cemetery Company enter into discussions to craft a mutually acceptable conservation plan for the preservation and conservation of the heritage attributes of the cemetery based on mutually acceptable, recognized heritage standards.

That item b) of the original motion be amended by adding the following:

“and if an agreement cannot be reached, staff would seek direction from Council”.


 

Council at its meeting of October 6, 2008, made the following recommendation:

a) That the recommendation from the Municipal Heritage Committee (PACAC) not to designate the property known as Little Lake Cemetery at this time as a heritage property under Part IV, Section 29 of the Ontario Heritage Act (R.S.O. 1990 c.O.18) be received; and,

b) That staff be directed to enter into discussions with the Little Lake Cemetery Company to finalize a mutually acceptable conservation plan for the preservation and conservation of the heritage attributes of the cemetery based on acceptable, recognized heritage standards to be finalized on or before February 1, 2009; and,

c) That staff be directed to proceed to register a Heritage Conservation Easement on title with the associated conservation plan; and

d) That the Municipal Heritage Committee (PACAC) and Council will review the issue of heritage designation of Little Lake Cemetery upon completion of the above, or if (b) is unsuccessful by the date set out, to proceed with designation immediately.
