That the decision of this Council, on April 10, 2007, to deny the application for rezoning submitted by 1392927 Ontario Inc. and 1437791 Ontario Inc., be reconsidered, and that this matter be referred to the Planning Committee meeting of May 7, 2007 for consideration and recommendation.

PLANNING COMMITTEE REPORT NO. 6

APRIL 16, 2007

TO THE COUNCIL OF THE CITY OF PETERBOROUGH, FOR CONSIDERATION AT ITS MEETING HELD APRIL 23, 2007

THE PLANNING COMMITTEE, AS A RESULT OF ITS MEETING HELD ON APRIL 16, 2007, RECOMMENDS AS FOLLOWS:

1. Director of Planning and Development Services

Report PLPD07- 017

Heritage Park – Phase II

Proposed Rezoning to Reduce Sideyard Setbacks

That staff develop a rationale for the decision to deny the application for Report PLPD07- 017, the Heritage Park Phase II, Reduced Sideyard Setbacks:

The three main issues for denial are:

a) It does not improve the streetscape

b) Future maintenance issues

c) Storm water management

Clerk’s Note

Further to the meeting of April 16, 2007, as per clause 10.9 of Bill 51, “Notice of Refusal”, the following information is provided for Council consideration and possible adoption:

The reasons for Council’s refusal to amend the zoning by-law for 1392927 Ontario Inc and 1437791 Ontario Inc (Heritage Park Phase II), shall be stated as follows:

a) The application to reduce the side yard setback will not improve the streetscape

b) The proposed side yard reduction will create future maintenance challenges for homeowners.

c) The proposed side yard reduction will complicate storm water management and lot drainage.

Council at its meeting of April 23, 2007, made the following recommendation:

That the decision of this Council, on April 10, 2007, to deny the application for rezoning submitted by 1392927 Ontario Inc. and 1437791 Ontario Inc., be reconsidered, and that this matter be referred to the Planning Committee meeting of May 7, 2007 for consideration and recommendation.

That the matter be referred.
