New Business

Councillor Clarke advised that Budget Document indicates bridge construction that is valued at over $500,000. The City has received the funding to allow the two bridges to proceed.

That permission be provided to Councillor Clarke to introduce a motion.

That the CAO provide a report to Committee of the Whole on the impact to Public Transit, Handi-Van policies, procedures and service delivery resulting from the recent attention and commentary.

Councillor Hall enquired about the review of the improvements to the Transit system and the schedule for the review to come back to council. Mr. Rye indicated that the review is continuing as improvements are implemented. A report will be provided at a future meeting in late February or early March.

Councillor Vass enquired about purchasing used buses. Mr. Rye indicated that eight used buses are being inspected this week.

Councillor Vass indicated that the Kawartha Cup snowmobile race will be held on January 26, 27 and 28 if there is enough snow available at Morrow Park. Snowmaking equipment is available if a hydrant can be used and Councillor Vass would support this initiative

That Council approach the PUC to authorize the use of water from a hydrant for snowmaking equipment at Morrow Park for the Kawartha Cup snowmobile races if necessary.

Councillor Peeters enquired whether there is an alternative site for snow dumping in Ashburnham.

That Councillor Peeters be allowed to introduce a motion at this time.

That staff be directed to bring forward the previous report that was compiled on this matter for Council review and that further action can be determined after review of this document.

Councillor Martin introduced a Buy Locally owned initiative. There is a media event February 1, 2007.

Councillor Peeters wondered about the structural integrity of the Hunter Street Bridge. Mr. Rye indicated that there has been a review of Hunter Street bridge and that the bridge has gone through the EA process.

Report USWM07-002

Extension of Operations and Maintenance Contract for the Peterborough County/City Waste Management Facility

That Council approve the recommendations outlined in report USWM07-002 dated January 8, 2007, of the Director of Utility Services, as follows:

a) That Council approve the extension of the Operations and Maintenance Contract for the Peterborough County/City Waste Management Facility with Waste Management Inc., formerly known as Canadian Waste Services Inc., for the life of the South Fill Area; and

b) That a by-law be passed authorizing the Mayor and Clerk to sign the contract addendum thereby extending the Peterborough County/City Waste Management Facility Operating Contract based on the negotiated terms.

Report USEC07-005

Award of Tender T-37-06 for Material Testing Services

That Council approve the recommendations outlined in report USEC07-005 dated January 8, 2007, of the Director of Utility Services, as follows:

a) That the tender of Geo-Logic Inc., 347 Pido Road, Units 28-30, Peterborough, Ontario, K9J 6Z8, for Contract T-37-06 (Tender for Material Testing Services) be accepted at an estimated annual cost of $50,000; and

b) That staff, provided all parties to the contract agree, be authorized to extend this service contract annually until December 31, 2010 at the same unit prices bid.

Procedural By-Law Amendment – Budget Standing Committee

That Council approve the recommendations outlined in report FACLK07-001 dated January 8, 2007, of the City Clerk as follows:

a) That a standing committee, composed of all members of Council, be formalized as the Budget Committee to recognize the governance responsibilities within the budget process and to more accurately reflect the role of the Committee,

b) That the Procedural By-Law of the Corporation be amended to provide for a Budget Committee as a standing committee of Council;

c) That notice of this proposed amendment be deemed to have been sufficiently provided by the making of this recommendation by Committee and;

d) That a Terms of Reference be developed for this committee to be presented to Council at a future meeting.

That Council approve the recommendation outlined in report FAFS07-001 dated January 8, 2007, of the Director of Finance and Administrative Services as follows:

That the draft 2007 Budget Documents be referred to the Budget Committee to be reviewed in detail the week of January 29, 2007.

That Council approve the recommendation outlined in report CSRS07-001 dated January 8, 2007 of the Director of Community Services, as follows:

That the revised Screening Criteria for the 2006 Civic Awards Program be approved as contained within this report.

Report CSACH07-001

Heritage Designation of Historic Property

That Council approve the recommendations outlined in report CSACH07-001 dated January 8th, 2007, of the Director of Community Services, as follows:

a) That the recommendation of the Peterborough Architectural Conservation Advisory Committee (PACAC) to designate the structures at 189 Hunter Street West and 432 George Street North, as heritage properties under Part IV, section 29 of the Ontario Heritage Act (R.S.O. 1990, c.0.18) being of “cultural heritage value or interest”, be approved; and,

b) That the City Clerk be requested to publish Council’s intention to designate in a newspaper having general circulation in the municipality as per the Ontario Heritage Act R.S.O. 1990, c. O.18, s. 31 (3); and,

c) That the Heritage Preservation Officer be requested to serve the owner(s) of the properties to be designated, and the Ontario Heritage Trust with a notice of intention to designate as per the Ontario Heritage Act R.S.O. 1990, c. O.18, s. 31 (3)

9. Director of Community Services

Report CSD07-001

Arenas, Parks and Recreation Advisory Committee By-Law

That Council approve the recommendation outlined in report CSD07-001 dated January 8, 2007 of the Director of Community Services as follows:

a) That By-Law 1983-58, A By-Law to authorize the Carrying on of a Community Programme of Recreation within the meaning of the Regulations under the Ministry of Culture and Recreation Act be repealed;

b) That By-Law 98-152, A By-Law to amend By-Law 1983-58 be repealed;

c) That the Arenas Advisory Committee as established on March 8, 2004 be dissolved;

d) That By-Law 2007-003, A By-Law to establish an Arenas, Parks and Recreation Advisory Committee be passed.

That Item 4.4 be amended to replace “shall” with “may”.

That Item 4.1 be amended by removing “for the member’s term on Council” and adding “at the pleasure of Council”.

Council, at its meeting of January 15, 2007, passed the following resolution:

That Item #9, Report Number 1 be deferred until the next cycle of Committee of the Whole.

Report USWM07-001

Stewardship Ontario Funding Agreement for Regionalizing Recycling Processing Services

That Council approve the recommendation outlined in report USWM07-001 dated January 8, 2007, of the Director of Utility Services, as follows:

That a by-law be passed authorizing the Mayor and Clerk to sign the Stewardship Ontario Effectiveness and Efficiency Fund Grant Agreement in the amount of $7,500, plus GST, for a Regionalizing Recycling Processing Study.

11. Director of Planning and Development Services

Report PLPD07-001

Municipal Capital Facility Designation for 225 Stewart Street (Former Bread Factory)

That Council approve the recommendations outlined in report PLPD07-001 dated January 8, 2007, of the Director of Planning and Development Services, as follows:

a) That the property situated at 225 Stewart Street (former Bread Factory) be designated as a Municipal Capital Facility; and

b) That Council authorize the transfer of $58,000 from the Affordable Housing Partnership Fund established under the “Taking Charge” policy to the tax account for 225 Stewart Street to cover the premium cost of the “multi-residential” tax rate between 2003 and 2006.

Provincial Gas Tax Program

That Council approve the recommendations in Report USTR07-001 dated January 8, 2007 of the Director of Utility Services, as follows:

a) That a by-law be passed authorizing the Mayor and Clerk to sign a Letter of Agreement between the Province of Ontario represented by the Minister of Transportation for the Province of Ontario and The City of Peterborough to facilitate provincial funding to the City under the Dedicated Gas Tax Funds for Public Transportation Program; and

b) That approval be granted for the City of Peterborough Ridership Growth and Asset Management Plans, which have been developed to fulfill eligibility requirements for continued receipt of funding under the Dedicated Gas Tax Funds for Public Transportation Program.

City of Peterborough/Ministry of Transportation Agreement – Hwy 115/Parkway Interchange

That Council approve the recommendations in Report USEC07-001 dated January 8, 2007 of the Director of Utility Services, as follows:

a) That a by-law be passed authorizing the Mayor and Clerk to sign an Agreement between Her Majesty the Queen, represented by the Minister of Transportation for the Province of Ontario, and The Corporation of the City of Peterborough to facilitate a Class Environmental Assessment and preliminary design study for upgrades to the Highway 115 / Parkway Interchange; and

b) That approval be granted in advance of the 2007 Capital Budget approval, $75,000 be pre-committed from the Development Charges Reserve Fund to cover the estimated City share of costs to complete the Class Environmental Assessment and preliminary design study.

Extension of Sanitary Sewer Cleaning, Reaming and CCTV Contract T-19-06

That Council approve the recommendation in Report USEC07-002 dated January 8, 2007 of the Director of Utility Services, as follows:

That Purchase Order No. 24998 issued for Contract T-19-06 to Sewer Technologies Inc., 2 – 27 West Beaver Creek Road, Richmond Hill, Ontario, L4B 1M8, be extended by $38,149.85 plus GST, in the form of a contingency allowance, to permit completion of the sanitary sewer cleaning, reaming and CCTV inspection contract.

Class Environmental Assessment Update

That Council approve the recommendation in Report USEC07-004 dated January 8, 2007 of the Director of Utility Services, as follows:

That the presentation by McCormick Rankin Corporation regarding the Lansdowne Street West Class Environmental Assessment be received for information.

16. Director of Utility Services

Report USWM07-003

Information Report on Waste Management Tipping Fees

That Council approves the recommendation outlined in Report USWM07-003 dated January 8, 2007, of the Director of Utilities Services Department, as follows:

That report USWM07-003 be received for information, and be deferred to the Budget Committee for discussions during its review of the 2007 draft budget scheduled for the week of January 29, 2007.

17. Green-up Peterborough

That Councillor Martin be appointed as the Council representative on Green-up Peterborough.


 

18. Official Plan Policy Objective

That staff prepare a report addressing the Official Plan policy objective promoting urban renewal and further that the report specifically discuss potential incentive programs, similar to the Heritage Tax Credit and that the report be brought back in a timely fashion.

19. Hours of Liquor Sales

That staff prepare a report on the hours of liquor sales in establishments in Peterborough.
