THE PLANNING COMMITTEE, AS A RESULT OF ITS MEETING HELD ON MONDAY, AUGUST 28, 2006, RECOMMENDS AS FOLLOWS:

1. Heritage Preservation Officer

Report CSCH06-009

Heritage Designation of Historic Property

That Council approve the recommendations outlined in report CSCH06-009 dated August 28, 2006, of the Heritage Preservation Officer, as follows:

a) That the recommendation of the Peterborough Architectural Conservation Advisory Committee (PACAC) to designate the building at 17 Merino Road, as a heritage property under Part IV, section 29 of the Ontario Heritage Act (R.S.O. 1990, c.0.18) as being of “cultural heritage value or interest”, be approved; and,

b) That the City Clerk be requested to publish Council’s intention to designate in a newspaper having general circulation in the municipality as per the Ontario Heritage Act R.S.O. 1990, c. O.18, s. 31 (3); and,

c) That the Heritage Preservation Officer be requested to serve the owner(s) of the property to be designated, and the Ontario Heritage Trust with a notice of intention to designate as per the Ontario Heritage Act R.S.O. 1990, c. O.18, s. 31 (3)

2. Planner, Land Use

That Council approve the recommendations outlined in Report PLPD06-063, dated August 28, 2006 of the Land Use Planner, as follows:

a) That the zoning of 300 Spillsbury Drive, be amended to a “modified” Residential District R.5 zone, as set out in the draft by-law, included as Exhibit ‘D’ to Report PLPD06-063;

b) That the modifications to the R.5 zone address the following:

i) Include a maximum number of units of 90;

ii) Reduce the maximum number of storeys from 5 to 3; and

iii) Increase the maximum lot coverage by open parking, driveways and vehicle movement areas from 25% to 35%.

c) That a “H” Holding Symbol be placed on the R.5 – 228 zone for the subject property, to be removed conditional upon the following:

i) Approval of a site plan and entering into a site plan agreement, which would also include a contractual obligation on the part of the Owner to develop the site as a residential condominium; and

ii) Council providing draft condominium approval including a condition requiring the Condominium Declaration to provide a restriction requiring the approval of the Condominium Corporation to allow rental of individual units.

a) That the services of Balterre Contracting Ltd., P.O. Box 594, Norwood, Ontario, K0L 2V0 be retained to provide construction services to complete the disconnection of sanitary sewer cross-connections at an upset limit fee of $51,133.00 plus $3,067.98 GST, for a total amount of $54,200.98; and

b) That the Mayor and Clerk be authorized to sign and seal the quotation document agreement.

5. Report FAFS06-023

Collection Agency Costs

That Council approve the recommendations outlined in report FAFS06-023 dated September 5, 2006, of the Director of Finance and Administrative Services as follows:

a) That a by-law be passed authorizing collection fees charged by Premier Receivables Management Ltd. on City of Peterborough outstanding receivables to be added to the outstanding receivable.

b) And that the maximum collection fee be established at 25% of the total receivable amount.

a) That Tender T-24-06 for asphalt resurfacing of various streets in the City of Peterborough be reduced in original scope and awarded to Lafarge Paving & Construction Ltd., Box 1299, Peterborough, Ontario K9J 7H5 in the amount of $491,247.88 plus GST of $29,474.87 for a total of $520,722.75. The unit prices bid in Tender T-24-06 include Provincial Sales Tax.

b) A By-Law be passed authorizing the Mayor and Clerk to sign and seal the contract documents.

That Council approve the recommendations in Report USTR06-018 dated September 5, 2006 from the Manager of Transportation, as follows:

a) That the quotation of Fortran Traffic Systems Limited, 470 Midwest Road, Toronto, Ontario, M1P 4Y5 for the supply of Computerized Traffic Signal Control equipment and Services in the amount, excluding GST and PST, of $542,000.00 be approved; and

b) That a by-law be passed authorizing the Mayor and Clerk to sign and seal the contract documents.

Strategic Downtown Parking Management Study (P-18-06)

That Council approve the recommendations outlined in report USTR06-020 dated September 5, 2006, of the Manager of Transportation, as follows:

a) That the proposal of IBI Group, 230 Richmond Street West, Toronto, Ontario, M5V 1V6, in the amount of $55,760.00 plus $3,345.00 GST, for a total amount of $59,105.00 for Proposal P-18-06 Strategic Downtown Parking Management Study, be awarded; and

b) That funds in the amount of $5,760.00 be transferred from the Parking Equipment Capital Budget to cover the unfunded portion of the cost of this study; and

c) That a by-law be passed authorizing the Mayor and Clerk to sign and seal the Consulting Agreement.

That Council approve the recommendations in Report USTR06-017 dated September 5, 2006 from the Manager of Transportation, as follows:

a) That the Proposal from Fortran Traffic Systems Limited, 470 Midwest Road, Toronto, Ontario, M1P 4Y5 for the supply of traffic signal controllers and related equipment for a three year period, commencing September 14, 2006 in the total three year amount, excluding GST and PST, of $478,979.63 be approved; and

b) That a by-law be passed authorizing the Mayor and Clerk to sign and seal the contract documents.

Update of the 2002 Comprehensive Transportation Master Plan

That Council approve the recommendations outlined in report USTR06-021 dated September 5, 2006, of the Director of Utility Services, as follows:

a) That the scope of the proposed update as outlined in report USTR06-021 be approved and;

b) That a 2007 capital budget for the proposed update be included in the draft 2007 capital budget to be considered for funding by the next Council.

Joel Parkes

Transfer of GST Revenue to Municipalities

That the correspondence from Joel Parkes regarding a Private Member’s Bill proposing a transfer of 1% of GST revenue to municipalities be received for information and that the letter be forwarded to MP Dean DelMastro with an invitation to discuss this with Council.

23. Veteran’s Signs on River Road

Councillor Vass enquired about Mr. Gary Smith’s request for Veterans signs being erected on River Road.

That City Staff provide a report in respect to renaming Nassau Mills Road to Veteran’s Road.

24. Pond around Dutton Road

Councillor Eggleton enquired about the condition of the pond around Dutton Road. Mr. Hunt indicated that staff would speak to the developer about this matter.

25. Wallis Drive Transit Route

Councillor Doris enquired about Wallis Drive transit route deletion and the review of the transit system that will occur. Mr. Kimble indicated that the overall success of the project to be reviewed in six months. Individual route changes are an administrative issue and should be referred to the transit division.

MEETING OF SEPTEMBER 11, 2006

TO THE COUNCIL OF THE CITY OF PETERBOROUGH FOR CONSIDERATION AT ITS MEETING HELD SEPTEMBER 11, 2006

THE COMMITTEE OF THE WHOLE, AS A RESULT OF ITS MEETING HELD ON SEPTEMBER 11, 2006, RECOMMENDS AS FOLLOWS:

1. Report USEC06-039

Canada Ontario Municipal Rural Infrastructure Fund (COMRIF) Application - Intake Three

That Council pass the following Resolution:

WHEREAS the Council of the City of Peterborough has received and considered the Canada-Ontario Municipal Rural Infrastructure Fund (COMRIF) Application Guidebook;

AND WHEREAS Council has assessed the capital priorities of the municipality against the requirements, as set out in the COMRIF Infrastructure Fund Application Guidebook;

AND WHEREAS Council considers the rehabilitation of the Bonnacord Street and Park Street Bridges over Jackson Creek, described in the application, for COMRIF – Intake Three to be its highest priority;

NOW THEREFORE Council endorses and directs staff to submit the application to the COMRIF Joint Secretariat by September 13, 2006.
